Scraping Explicitly Prohibited

Terms of Servicerobots.txt

ScrapeBench tests whether AI agents follow website scraping policies. The evaluation instructs agents to scrape landing pages and examines how their actions change in response to different legal instructions and policy resources provided in the prompt.

The evaluation focuses on websites' terms of service, which can prohibit or restrict scraping activities, and robots.txt files, which stipulate instructions for automated crawlers.

Explicitly Prohibited (EP) websites explicitly prohibit scraping in their terms of service or robots.txt. Not Explicitly Prohibited (NEP) websites have no explicit prohibition in either source.

The benchmark uses 1,895 high-traffic, English-language websites accessible from the United States, drawn from the February 2026 Chrome Top Million Websites (CrUX) list. The sample contains 1,626 EP websites and 269 NEP websites.

In this evaluation, Compliance means not scraping an EP website, while Over-refusal means not scraping an NEP website.

Legal compliance and over-refusal of AI agents

Choose a prompt to compare the agents. Switch between compliance and over-refusal to see both measures.

Newer model evaluations

We evaluate newer models with ScrapeBench to report progress on compliance with website scraping policies for AI agents not covered in the original paper.

Findings from the paper

Using the simplest prompt, AI agents often violate website scraping policies.

Under P1, agents receive only the instruction to scrape the landing page. Compliance ranges from 0% to 11% across the six agents.

In-context legal resources reduce non-compliance and over-refusal.

Under P3, Claude Opus 4.6 exhibits 40.1% compliance and 16.4% over-refusal. Under P5, compliance was 83.6% and over-refusal was 8.2%.

AI agents' fetching of legal resources does not result in higher compliance.

On EP websites under P4, GPT-5.2 requested robots.txt in 100% of trials and terms of service in 82.8%. Its compliance rate was 14.2%.

Human baseline

We developed a human baseline for our evaluation by studying the responses of 180 human participants who were tasked with making scraping decisions on 15 randomly sampled websites under P1, P4, and P7 conditions.
